Hawaii Dairy Farms Pays For Environment Restoration

As a result of a Consent Judgment Order in relation to a lawsuit that had been filed by the Friends of Mahaulepu against the Hawaii Dairy Farm $125,000 will be paid to the Makauwahi Cave Reserve by Hawaii Dairy Farm. This money will go towards the management of stream banks, wetlands and endangered species on Waiopili Stream.
The lawsuit was filed some time back after it was found that Hawaii Dairy Farms was doing irrigation work on the property without authorization to do so.
The consent decree allows Hawaii Dairy Farms to continue mowing and trimming grass and vegetation, but ditch maintenance and any other activity that constitutes disturbing the land aren’t allowed, as long as the consent decree stands.

Villages At Poipu New Subdivision, To Be Or Not To Be? 
If you don’t know about this subdivision it’s because of the location.  Villages At Poipu Phase One is located behind the Poipu Beach Athletic Club and is on Knudson land.  The Hapa Trail, tree’s and wild brush frame the site.  But if you look carefully you can see paved streets and landscaping.  According to County tax records the land in the photo has two tax classifications; Agricultural and Residential. It’s owned by the Knudson Trust and is 110.25 acres, at the site today you can see paved streets and landscaping.

Shortly after the work started in 2009 a Koloa resident filed a lawsuit and has fought several battles in court over these last 8 years. This last week a Kauai judge ruled that the State, County of Kauai and the Eric A. Knudsen Trust violated laws preserving and protecting Hawaiian rights and cultural resources when the developer’s Village at Poipu Phase One subdivision was approved in 2009. Her ruling “vacates the county’s approval of the final subdivision plans”. This means that they have to go back through the permitting process.  The reason for this ruling is because the County of Kauai did not abide by procedures in place to govern the preservation of historic properties when granting the subdivision approval.  A related matter has been the developer’s battle to take over Hapa Trail, which would be the main ingress and egress of the subdivision. In a 2010 court case Judge Randal Valenciano ruled that the State owns Hapa Trail thus making it a State Road and that it does not belong to the County of Kauai as the County had claimed. This decision coming one year after the groundbreaking of the subdivision started.

Japan Airlines Resumes Nonstop Flights
Japan Airlines will resume nonstop flights between Tokyo and the Kona airport on Hawaii Island this fall after a seven-year absence, providing $84.2 million in annual visitor spending. Governor Ige stated that the re-established route will create $9.8 million in state tax revenue and will support more than 900 jobs.

According the the CEO of the Hawaii Tourism Authority all islands benefit, he stated; “The financials from this route is great, and for us to be able to get more access to the Neighbor Islands has been part of our strategic plan all along. This brings balance to the whole state.”

Sales and Median Prices Up For Kauai Real Estate Year To Date
The number of Residential, Condominium and Land Sales are up in all categories island wide, the Median Price is down for Land but up for Residential and Condominiums. Real Estate activity on the island of Kauai continues to stay on an upward path.
