Last week I SOLD unit #406 at the Kiahuna Plantation for $5,000 over asking price. This ground floor corner unit 1 bedroom 1 bath had several offers on it and my clients were the successful buyers at $35,000 (LH). This unit checks a couple of key boxes; ground floor with a no stair entry, level lanai with the lawn and a corner location to be able to take advantage of the trade winds. Legislative Bills You Should Know About

Last Thursday I attended a class that updated me on the last Hawaii State Legislative session where some bills got approved that would be of interest to those with property, or those thinking about getting property, here on Kauai. I’m giving you a brief outline of the bill and including a hyperlink for you to review the Bill in its entirety;

House Bill 1498 – Pertaining to Condominium Associations
Copies of contracts, written job descriptions and job compensation between the Association and any person retained to manage the operation of the property on-site to be made available to any unit owner. Certain personal information to be redacted from the contracts. Effective July 1, 2017

House Bill 1244 – Cesspools Upgrades
This bill requires all cesspools in the state to be upgraded or converted into more environmentally friendly waste treatment systems or connected to a sewer systems before January 1, 2050. What this means for Kauai is upgrading your system to septic, we don’t have a lot of sewer systems. For those areas on Kauai that have sewer systems available the homes are already connected so this would be a none issue. Effective July 1, 2017

Senate Bill 119 – Cap on Late Fee’s For Rents
A cap of 8% on late rent payment fees which would be applicable to all new rental agreements and rental agreement renewals entered into on, or after effective date of the bill. Effective November 1, 2017

Senate Bill 369 – Prohibits Retaliation Related to Condominium Complaints
Protects a condominium owner against retaliation from condominium associations, boards, managing agents, resident managers, other owners and persons acting on behalf of an association or condominium owner from retaliating against a condominium owner after they have filed a complaint. I have not heard of that happening here on Kauai so I’m assuming this came from an incident on some other island. Effective July 1, 2017

Affordable Housing In Poipu
I attended a town meeting at the Koloa Community Center where the topic was an affordable apartment complex that is going to be built here in Poipu Beach. This is housing is nothing new, before Kukui’ula was allowed to develop their project they agreed to some things that the County of Kauai wanted them to do for the community. Some of those we see today; the roundabout in Poipu, the community housing on the bypass road, the bypass road itself etc.

At the meeting they talked about the 11.2 acre parcel of land that is located right off of Poipu Road in between the solar panels by the Kiahuna Golf Course and the entrance to Koloa Estates. There will be 24 two story buildings with a total of 134 apartments for rent, a community center and parking will be on the interior of the complex so you won’t see a bunch of cars when you drive by. Preference will be given to Employees working within the area and those working with the County. Applicants are required to have a household income that does not exceed 60% of Kauai’s Median Income.

Across from the complex is to be a park that will be open to everyone. Construction will start January 2018 and should be completed by December of 2019.
