Major Law Firm Files Class Action Lawsuit Against Zillow
Hagens Berman and Cohen Milstein are the attorneys who took on, and won, their anti-trust lawsuit against the National Association of Realtors and several humungous real estate companies.  With that win how commissions are paid changed for the United States.  Now they are going after Zillow.
The class action lawsuit is on behalf of all U.S. buyers who bought a home using an agent that they got off of the Zillow platform.

An excerpt from the complaint spells it out the best; “When a house is for sale on Zillow, the Zillow website has a big button in bright blue lettering posted next to the house listing that says “Contact Agent”:  After clicking that button, potential buyers are asked to provide their contact information, which Zillow provides to a Zillow-affiliated agent. Buyers, however, naturally believe they are contacting the listing agent. Instead, they are routed to a Zillow-affiliated buyer’s agent, who arranges a tour of the home by getting the buyer to sign a “Touring Agreement.” (The same process occurs if the potential buyer clicks the blue “Request a Tour” button.). The “Touring Agreement” promises the buyer that the agent’s services are “free,” but this is deceptive and not true: if the sale goes through, the buyer’s agent still receives a commission. In addition, if the Zillow-affiliated agent is a “Flex” agent, he or she has to pay Zillow up to 40% of the agent’s commission.  This cut of the commission paid to Zillow, for no services rendered related to the real estate sale, is never disclosed to the buyer or the seller (the “Hidden Zillow Fees”).”

Kauai Vacation Rental Properties Days On Market Are; 0 to 365
A Poipu Beach oceanfront vacation rental just sold for $1.255 million — and it never even hit the market. Meanwhile, other condos at the same price point in the same area sit unsold. For those sellers, it’s easy to start asking: is it the property, the price, or even the agent? The truth is, it might be none of those things.
Real Estate 101 says that if a property hasn’t sold after 30 days, it’s a warning sign the price may be too high. After 30 days, drop the price. If it still hasn’t moved after 60–90 days, drop again. Beyond that, buyers start to think something must be wrong.
But here’s where it gets interesting. In a second-home market like Poipu, the 30–60–90 day playbook doesn’t apply. My recent buyers toured other condos they liked, but ultimately realized there was only one complex they truly wanted to own in. Once they knew that, nothing else would do. I found them a property in that complex that wasn’t on the market — and that’s the one they bought.
Now, imagine being the owner of a condo they toured. The buyers loved your unit, but bought something off-market instead. You’d be left wondering: what happened?
The reality is that some properties take longer to sell for reasons that go beyond price or condition. In some cases, there are adjustments you can make and I’ll be writing about that next week.

Hawaii Has Third Highest Condominium Dues In U.S.
Hawaii has the third highest Median Price at $470.00 for condominium dues in the United States coming in behind New York at $740.00 and District of Columbia at $505.00. 
Condominium complexes on Kauai will run significantly higher than the states Median $470.00.  Our island has a building height restriction which makes most of our complex’s low density meaning; the less condos to pay dues the higher the dues.  Additionally, Kauai condominiums in the resort areas mean extra amenities that vacationers expect which add to the dues.  Kauai vacation rental condominiums are typically in the starting range of $1,500 a month.
On a national level 25% of people live in an area with condominium or HOA fee’s, that number is just about double in Hawaii. 

Where can you go to pay the lowest fees?  Alaska, Wyoming, Arkansas and Oklahoma pay less than the National Median monthly rate at $135.00

Second MRI Machine on Westside
Kauai now has two MRI machines thanks to a $10.6 million dollar grant made by the Leona M. and Harry B. Helmsley Charitable Trust.  The grant enabled the Kauai Veterans Memorial Hospital to expand and develop its MRI suite.
The other MRI is located at Wilcox Hospital in Lihue.

Oahu, Maui and Big Island Real Estate 
Below is a graph of the Year-To-Date real estate activity for all of the islands.  The number of sales are down pretty much across the board, with the exception of Kauai Homes which are slightly up.  The Median Price is down except for Kauai’s condominiums and Homes on the Big Island and Oahu.
