Kauai Real Estate Update, Kauai Storms, Kauai Chicken Legislation, Nihi Kai Just Listed

Kauai Real Estate Update-  I’m watching February closely as we were really behind on our January numbers compared to the year before but, we had a larger number of multi-million dollar properties under contract.  Those started closing just this last week and that had a very favorable impact on our Median Price.  For last week here is what Sold, was Just Listed and what went Under Contract on the island:  Kauai Real Estate Activity February 2 to 8, 2026.

This Might Be The Real Reason That Buyer Cancelled
What looks like a sudden cancellation by the Buyer or an unreasonable response from the Seller is often something else entirely. People are making big decisions, with a lot of money and emotion attached—and this isn’t normal emotional territory for them.
When that pressure shows up, fear shows up. And fear changes how people listen, react, and communicate.  At that point it can be on the Realtor to be able to navigate the emotional landscape that the transaction has turned into, this requires the agent(s) to have emotional intelligence.
Sometimes they do, and sometimes they don’t.  And even when they do, it might not be enough.

Severe Windy Weather For Kauai
Wind, Rain and Temperatures in the 60’s have been our norm for the last several days.  Monday saw school closures and warnings to avoid travel if you can. 
The greatest impact has been on the windward (Eastern) and mauka (mountain) areas.  Here on the South Shore I can report we’ve had light to heavy rain on and it’s been very windy.
There has been flood watches and wind gusts in the 40 to 50 mph range.
Rain is predicted for the rest of the week, schools are set to reopen on Tuesday, February 10.

Two Bills To Deal With Kauai Chickens 
Actually, not just Kauai but the entire state is not wanting to tolerate feral chickens any longer. 
Kauai has had a very high number of feral chickens for many, many years and we’re probably the most used to them.  We don’t have mongoose threatening them like the other islands do and visitors have a soft spot for them and like to feed them.  So, they thrive on Kauai.
Two bills, that are facing zero opposition, are being considered for our next legislative session and it’s not good news for roosters or chickens.
House Bill 1852 and House Bill 980 take different approaches but both allow residents to kill feral chickens that are on their property.  How they can be killed is not defined but “torture and extreme abuse” are outlawed.  The birds also lose their “wild birds” definition which currently protects them.  In 2023 legislation was introduced to increase fines for those feeding feral chickens but, this has done little to decrease their population.

Why now?  Several reasons were given for this coming back on the radar screen:
🐓 Feral chickens taking over private property and agitating household pets
🐓 Dangerous situations created for drivers swerving to miss them on the road
🐓 They increase chance of Bird Flu being spread
🐓 From March 2024 to February 2025 Sixty-Eight cases of Bird Flu have spread to humans
🐓 Parks, businesses and schools being overrun by them.
🐓 Threats to Hawaii’s ecosystem.

Kauai Chicken Pox Cases On The Rise
This new is totally unrelated!  Since January 23rd, 2026 there has been a total of 10 cases of Chicken Pox reported in Kauai elementary schools.  Those schools include:
Kilauea Elementary School
Hanalei Elementary School
Kauai Christian Academy
Island School

Nine of the children were not vaccinated and one had been partially vaccinated. 

Zillow Allowed To Enforce Listing Policies Against Compass, For Now
Did you know;  if your property is advertised for sale publicly, but not on the Multiple Listing Service (MLS), Zillow can ban the property from their site if it does go active on the MLS?  Zillow implemented that rule in April of 2025 and, that following June, the real estate company Compass filed an injunction to have the courts block that enforcement stating that Zillow was “abusing its monopoly power.”
On February 6th that injunction was denied by a Judge with the U.S. District Court. 
How this impacts you:  Zillow is widely used by people looking at properties and they get those properties from the Multiple Listing Services nationwide.  If the property is not on the MLS, people who are on the Zillow app don’t see them. 
I have no idea if this is related to the lawsuit but what I will add is this:  when people click on the “Contact Agent” button they are not sent to the listing agent but to a Zillow Premier agent and Zillow gets anywhere from 35 to 45 percent of that agents commission.  This practice of theirs is the subject of separate lawsuit that is still ongoing.
This is not over.  Zillow’s ban is allowed while the lawsuit that Compass filed continues on.  Last year Compass sued Zillow for antitrust violations alleging that the “Zillow Ban” is anti-competitive.
